OFFICIAL RULES
1. ELIGIBILITY: The “GRID™ eBay Motors Challenge” (“Contest”) is offered only in the fifty states of the United States and the District of Columbia and is open only to legal residents of the United States. Contest void in Puerto Rico and all U.S. territories and possessions. Entrant must be at least 16 (sixteen) years old, have a valid driver’s license (provisional or otherwise as allowed by entrant’s state of residence) and have registered their Xbox 360 game console with Xbox Live or have registered their PlayStation 3 game console with the PlayStation 3 Network, as of the entry date. Employees, officers, and directors of Codemasters Inc, (“Sponsor”), eBay Motors (Prize Provider), Microsoft Corporation, Sony Computer Entertainment America Inc, and Vertical Marketing Network LLC (Agency) and their respective affiliates, parent companies, subsidiaries, franchisees, contractors, distributors, advertising, promotion, fulfillment and marketing agencies, agents, attorneys, other entities involved in the design, development or implementation of the Contest, immediate families (defined as spouse, child, sibling, parent or grandparent) and persons living in the same household of each (whether related or not) are not eligible. By participating, entrant agrees he/she will be governed by these Official Rules and the decisions of the independent judging organization. Void where prohibited or restricted by law. All applicable U.S. federal, state and local taxes are the sole responsibility of winners.
The GRID™ eBay Motor Challenge begins on or about 12:00 a.m. ET on May 8, 2008 and ends at 11:59 p.m. ET. on May 25, 2008. Sponsor’s computer is the official clock for the Contest.
HOW TO ENTER: Beginning on or about May 8, 2008, download the GRID™ demo game (“Game”) from Xbox Live (at http://www.xbox.com) or the PlayStation 3 Network (at http//www.us.playstaion.com/PS3/Network) to the appropriate game console. Select the San Francisco GP track and beat the world record lap time of the San Francisco eBay Motors Muscle Cup Track online – offline racing will not count towards the Contest. Once you have beaten the world record lap time of the San Francisco eBay Motors Muscle Cup Track, select FINISH TIME TRIAL from the Pause Menu and follow the instructions. If you choose “YES”, you will be issued an alphanumeric code (“Code”) with instructions to go to the Contest website (http://community.grid-game.com/win-ebay-mustang). The Code verifies your race time. There you will enter the provided Code and register for the Contest. You will be asked to provide your name, mailing address (No P.O. Boxes accepted), console format and email address. The object of the game is to race for the best time in the GRID demo game. Once you have entered the Code, your race time, gamertag and time/date of your race time are posted on a leader board found at http://community.grid-game.com/win-ebay-mustang. Only the individual who registered his/her Xbox or PlayStation3 game console may download the Game once onto his/her Xbox or PlayStation 3 game console and participate in the Contest. Such individual may play the Game and participate in the Contest as often as he/she wishes during the promotional period. Any other downloading, copying or use of the Game is prohibited and is in violation of copyright and/or other intellectual property rights. Any person who attempts to participate with multiple street addresses, under multiple registrations will be disqualified.
ABOUT THE LEADER BOARD: While every reasonable effort will be made to maintain and accurately reflect on the Leader Board the individuals with the fastest times, Sponsor and its agencies assume no responsibility or liability for the accuracy, completeness or currency of the information on the Leader Board at any given time. Sponsor and its agencies reserve the right at any time, without notice or liability of any kind, to revise, amend or modify the information on the Leader Board. Sponsor and its agencies will periodically update the Leader Board time(s) of their sole choosing and in their sole discretion. For the foregoing reasons, you are cautioned that inclusion of your race time, your name and time/date of your race time on the final Leader Board (or any other posted Leader Board) does NOT constitute a representation by Sponsor and/or its agencies that you have won a prize in the Contest. REGARDLESS OF THE INFORMATION ON LEADER BOARD(S), YOU ARE NOT A POTENTIAL PRIZE WINNER UNLESS AND UNTIL YOU HAVE BEEN PERSONALLY NOTIFIED TO SUCH EFFECT BY SPONSOR AND ITS AGENCIES AND YOU ARE NOT A PRIZE WINNER UNTIL YOUR ELIGIBILITY AND COMPLIANCE WITH THESE OFFICIAL RULES HAS BEEN VERIFIED BY THE SPONSOR AND THE INDEPENDENT JUDGING ORGANIZATION (SEE PARAGRAPH 2 FOR FURTHER INFORMATION ON WINNER NOTIFICATION PROCEDURE).
2. WINNERS AND PRIZE AWARDING: The eligible individuals with the five fastest times, regardless of game platform, and who comply with the other rules and requirements of the Contest will be Finalist Prize Winners and are eligible to participate in “The eBay Motors Muscle Series Time Trial” at the GRID™ Launch Party in San Francisco, California on June 4, 2008. The eligible individual at “The eBay Motors Muscle Series Time Trial” at the GRID™ Launch Party with the fastest time will win the Grand Prize (subject to his/her compliance with these Official Rules). The final ranking of individuals’ times and the final ranking of the five fastest times will take place on or about May 26, 2008 under the supervision of Vertical Marketing Network LLC, an independent judging organization, whose decisions are final and binding on all matters relating to this Contest.
Potential winners will be notified by email.
FINALIST PRIZE: Potential winner of the Finalist Prize (if potential winner is a minor, his/her parent/legal guardian) will be required to sign and return an Affidavit of Eligibility, a Release of Liability, and a Release of Publicity (where legal) by May 29, 2008. If potential Finalist Prize Winner is a minor, his/her parent/legal guardian must accompany him/her on the prize trip. Finalist Prize winner’s travel guest (if guest is a minor, his/her parent/legal guardian), must sign and notarize a Liability Release and Publicity Release (where legal) to be returned prior to the issuance of travel documents. Finalist Prize Winner’s travel guest must accompany grand prize winner on the same travel itinerary. In the event of noncompliance with these requirements, the potential Finalist Prize winner may be disqualified. At the Sponsor’s discretion an alternate finalist winner may be selected (i.e., the entrant whose Game score (i.e., his/her time) was ranked immediately below that of the disqualified winner). Finalist Prizes unable to be fulfilled in the required time frame to participate in “The eBay Motors Muscle Series Time Trial” for the grand prize will not be awarded. Finalist Prizes will be awarded only upon winner verification by Vertical Marketing Network LLC.
GRAND PRIZE: On June 4, 2008 all five Finalist Winners will attend the GRID Launch Party and compete in “The eBay Motors Muscle Series Time Trial”. Each Finalist will race individually on their choice of either an Xbox 360 or PlayStation 3 game console. Finalists will race in random order determined by the Agency. The Finalist with the fastest time and who complies with these Official Rules and other requirements of the Contest will win the Grand Prize eBay Motors-liveried Ford Mustang GT. Potential winner of the Grand Prize (if potential winner is a minor, his/her parent/legal guardian) will be required to sign and return an Affidavit of Eligibility, a Release of Liability, and a Release of Publicity (where legal) by June 20, 2008. In the event of noncompliance with these requirements, or should the potential Grand Prize winner decline the Grand Prize, he/she will be disqualified. At the Sponsor’s discretion an alternate Finalist winner will be selected (i.e., the entrant whose Game score (i.e., his/her time) was ranked immediately below that of the disqualified winner). Grand Prize will be awarded only upon winner verification by Vertical Marketing Network LLC.
Limit one prize per household/individual/address/Xbox 360 or PlayStation 3 Registration; if the same person has more than one of the five fastest times, only his/her highest ranking (i.e., his/her fastest time) will be counted for purposes of prize awarding and all other times by that person will be ignored. For potential winners who are minors, the prize will be awarded in the care of his/her parent/legal guardian. No substitution, transfer or assignment of prize permitted, but the Sponsor reserves the right, at its sole discretion, to substitute a prize/prize component of equal or greater value should advertised prize/prize component become unavailable for any reason. For any prize, if prize notification email/communication or the potential winner declines the prize or the prize itself is returned as undeliverable, such prize will be forfeited and an alternate winner will be selected. All entries become the sole property of the Sponsor and will not be returned.
3. PRIZES & APPROXIMATE RETAIL VALUE (“ARV”): Five (5) Finalist Prizes - A trip for two to San Francisco, California to attend the GRID Launch Party on June 4, 2008 and participate in “The eBay Motors Muscle Series Time Trial” at the GRID Launch Party to determine the Grand Prize Winner. Finalist Prize winner and guest must travel together, must be available to travel June 3-5, 2008 and must attend the Launch Party on June 4. If winner is unavailable on such dates, prize will be forfeited in its entirety without compensation of any kind and the eligible individual with the next highest score will be selected as the winner. Prize includes roundtrip coach air travel from gateway commercial airport closest to winner’s residence (as determined by Sponsor in its sole discretion) to the San Francisco International Airport, San Francisco, California, 3-Day/2-Night hotel (standard, double occupancy) accommodations, entrance tickets to the Launch Party and $200 spending money (in the form of a check provided with travel documents prior to travel date). Trip is subject to availability and additional restrictions. All expenses not specified in these Official Rules are the sole responsibility of the Winner. On June 4, 2008, winner and guest will attend the GRID Launch Party where he/she will participate in “The eBay Motors Muscle Series Time Trial” to determine the winner of the Grand Prize. ARV: $1,800.00 each; total value of Finalist Prizes: $9,000
One (1) Grand Prize – a custom Ford Mustang GT as liveried by eBay Motors. Winner must furnish evidence of legally required insurance in order to claim vehicle as well as a valid driver’s license. Failure to retrieve vehicle within thirty days of notification may result in prize forfeiture. All costs and expenses associated with acceptance or use of Grand Prize are winner’s sole responsibility. The Mustang GT is subject to registration and other legal restrictions dependent upon your jurisdiction of residence: Compliance with such laws is winner’s sole responsibility. ARV: $60,000
ALL PRIZES ARE AWARDED “AS IS” EXCEPT FOR ANY STANDARD MANUFACTURER’S WARRANTY WHICH MAY ACCOMPANY THE PRIZE. Total Prize Pool ARV is $69,000
All prizes are non-transferable. If winner is a minor, the prize may, in Sponsor’s sole discretion, be awarded in the name of or to the winner’s parent or legal guardian on winner’s behalf. Prizes cannot be returned or exchanged for cash. Substitution of prizes by winners is prohibited. Sponsor reserves the right in their sole discretion to substitute advertised prize with a prize of comparable value in the event the advertised prize is not available for any reason. In the event that any winner chooses not to accept his/her prize or is unable to be notified, prize will be forfeited without compensation and an alternate will be notified.
Acceptance of prize constitutes permission from winner for Sponsor and its agencies to use winner’s name, voice, likeness and/or other indicia of person without notice or further compensation for purposes of advertising and trade, including posting of winner’s first name, last initial and city and state of residence on the GRID™ website, GRID™ community forums and the Contest website (http://community.grid-game.com/win-ebay-mustang) for a maximum of thirty (30) days, unless prohibited by law.
4. INTERNET: Participation in the Contest is subject to the Privacy Policy and Terms and Conditions of Use of the Sponsor, Playstation 3 Network, Xbox Live and eBay. If participant does NOT agree to the Privacy Policy and Terms and Conditions of Use, DO NOT USE THE WEBSITE OR PARTICIPATE IN THE CONTEST. Sponsor and its parent company, subsidiaries, and affiliates, and their respective advertising, promotion or production agencies are not responsible for technical, hardware, software or telecommunications malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to play or participate (including but not limited to defects/errors/ malfunctions in downloaded version of the Game), or by any error which may occur in the recording of times or other processing of Game plays. Use of any apparatus or device other than the standard Xbox game console to participate in the Contest constitutes tampering/attempted tampering and will result in disqualification.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW (AND TO DISQUALIFY SUCH INDIVIDUAL FROM THE CONTEST, IF APPLICABLE) If for any reason (including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest and renders the Contest incapable of being conducted as described in these Official Rules), Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest in whole or in part. In such event, Sponsor shall make all prizes available in a manner, determined by Sponsor in its sole discretion, to be fair, appropriate and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on the Contest Website (http://community.grid-game.com/win-ebay-mustang) and in the GRID™ community forum.
5. GENERAL RULES: By accepting prize, the winner agrees to be bound by these Official Rules and all the decisions of Vertical Marketing Network, LLC, the independent judging organization, which are final and binding in all respects; and to release the Sponsor, eBay Motors (Prize Provider), Microsoft Corporation, Sony Computer Entertainment America Inc. and Vertical Marketing Network LLC, and each of their respective parent companies, subsidiaries, affiliates, directors, officers, agents, attorneys, employees and other parties, from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, related to personal injury, death, damage to property, infringement of proprietary rights, rights of publicity or privacy or defamation) and attorney fees, whether or not in connection with litigation, including, but not limited to, any harm or loss caused by, contributed to, arising out of or related to winner’s participation in this Contest or use of the prize, including, but not limited to the winning, redemption, acceptance, possession or use/misuse of the prize. Sponsor makes no warranty or representation as to the quality, merchantability, or fitness for the intended purpose of any Prize/prize component; the only representations/warranties come from the prize supplier.
The Contest is governed by the laws of the State of California (excluding its principles of conflicts of laws/choice of laws), with venue in Los Angeles County and all claims must be resolved individually (NOT AS PART OF A CLASS) in the appropriate state and federal courts of Los Angeles County, California.
6. RULES/WINNERS LIST REQUESTS: Official Rules will be available online at the Contest Website (http://community.grid-game.com/win-ebay-mustang) during the Contest Period of May 8, 2008 to May 25, 2008.
